Tractor Supply Co. is accused of violating the Employee Retirement Income Security Act of 1974 (ERISA) over allegations the company implements a "tobacco surcharge," which unlawfully forces employees to pay higher premiums for their health insurance.

The class action, filed Sept. 23 in the U.S. District Court for the Middle District of Pennsylvania by Stueve Siegel Hanson, Weisberg Cummings, and the McClelland Law Firm, contends that the retail chain implements a "tobacco surcharge," which unjustly forces some employees to pay higher premiums for their health insurance in violation of ERISA and its anti-discrimination provisions.
