Question: What is the consequence of a delayed investigation of an ethical violation(s) of a judge?

A. Presuming prejudice to the judge-respondent, dismissal of the charge is appropriate where the delay was without due diligence or in bad faith.

In re DeLeon, 902 A.2d 1027 (C.J.D.Pa. 2006), the Supervising Judge of the Municipal Court of  Philadelphia County was charged by the Judicial Conduct Board with campaign fundraising violations.
