A federal judge in Pennsylvania declined the city of Philadelphia's request to appoint a different judge to a civil rights dispute, which primarily revolves around the same alleged unconstitutional conduct and parties the judge oversaw for years in a previous suit.

In a Monday decision, U.S. District Chief Judge Mitchell S. Goldberg of the Eastern District of Pennsylvania determined that under Local Civil Rule 40, fellow Pennsylvania Eastern District Judge Anita B. Brody would remain on a case related to one she previously oversaw. The city had requested a different judge oversee the suit, claiming they would face a disadvantage because "they would be forced to litigate in front of a district court judge that already found a constitutional violation occurred."
