Introduction


The holidays are not just for family and friends. It’s also the time of year when many lawyers prepare to transition to a new firm once the calendar turns over. This article is the first in a two-part series intended to de-mystify the attorney transition process and give both departing lawyers and their firms concrete pointers on how to ethically navigate attorney transitions.

This first article goes over the basics of the transition process with a focus on the applicable ethics requirements. A second article, to be published sometime in January, will address common contractual and ethical restrictions on an attorney’s practice and marketing at a new firm, as well as the points at which transitions most frequently go wrong.
