A federal judge in Pennsylvania in part sided with sports drink company Prime Hydration on Tuesday, finding the information at issue in the plaintiff's wiretapping violation claims didn't rise to an invasion of privacy.

In a Tuesday opinion, U.S. District Judge Nitza Quiñones Alejandro of the Eastern District of Pennsylvania determined Shantay Heaven lacked standing as the information allegedly collected by Prime wasn’t private information that, when disclosed, created a harm sufficient to establish standing. In a putative class action, Heaven alleged that Prime enabled Meta and Google to collect various communications of users who logged onto Prime's website, alleging Prime captured her searches for drink flavors like "ice pop," "meta moon," and "blue raspberry." Prime challenged the plaintiff's standing.
