Marc I. Simon, an attorney at the personal injury firm Simon & Simon, was sanctioned $7,500 after filing two erroneous complaints, with a federal judge ruling this week he violated Rule 11(b)(2) and (3).

U.S. District Judge Gerald Austin McHugh for the Eastern District of Pennsylvania determined sanctions were warranted after Simon filed a personal injury complaint on behalf of his client that lacked diversity, as well as a second amended complaint that misrepresented where the accident at the center of the lawsuit took place. After the second error, the court determined sanctions were warranted. According to the Monday opinion, "the unfounded factual and legal contentions in this case are inexcusable and weigh towards imposing significant sanctions, particularly when Mr. Simon was shown leniency after the first frivolous filing."'
