There has been a fair amount of discussion about the rights of parents or caregivers in the workplace. A recent decision from the U.S. District Court for the District of Maine reaffirms that Title VII does not prohibit discrimination based on an employee’s parental obligations but only provides protection if an employer treats caregivers differently according to sexual stereotypes.

In Chadwick v. Wellpoint Inc. , Laurie Chadwick, mother of 6-year-old triplets and an 11-year-old, was denied a promotion to a senior claims position in Wellpoint’s claims department in favor of another woman who also had children, ages 10 and 15. Chadwick brought suit against Wellpoint claiming she had been subjected to sexual stereotyping based upon her role as a mother and had been discriminatorily denied the sought-for promotion.
