A convicted drug offender’s attorney offered ineffective assistance to her client when she failed to challenge as excessive his sentence, which was more than five times the aggravated sentencing guidelines, the state Superior Court has ruled.

A three-judge panel voted 2-1 — with Judge Robert E. Colville concurring and dissenting — to reverse a Philadelphia trial court’s dismissal of Pedro Green’s petition filed under the Post Conviction Relief Act.
