A three-judge Superior Court panel has upheld a $4 million verdict against trustees of the University of Pennsylvania in a breach of contract case and ruled the plaintiff, a former head of pediatric dentistry at the school, was not entitled to prejudgment interest.

The Superior Court found no support for an entrance of judgment notwithstanding the verdict. The court dismissed Penn’s argument that an offer letter, which happened to lay out fee arrangements between the school and the plaintiff — who would help run a dental clinic — could not be construed as a contract.
