Two lawyers have questioned whether, under the Home Rule Charter, City Solicitor Shelley R. Smith may participate in the Philadelphia Bar Association’s judicial candidate ratings.

The attorneys — A. Charles Peruto Jr., a criminal defense lawyer, and Leon A. King II, who withdrew as a judicial candidate earlier this month — wrote to the Board of Ethics in April, questioning whether the bar’s judicial rating process is a political activity prohibited under the guidelines. The city Home Rule Charter bans most political activity by city employees.
