General practice physicians can face a medical malpractice claim if they have a sexual relationship with a patient while providing them with psychological care, an en banc panel of the Superior Court has ruled.

A 6-3 majority, led by Judge Richard B. Klein, decided there is “no reason” to differentiate between general practitioners and psychiatrists under such circumstances. Both doctors “need to maintain the same trust when rendering psychological care,” the panel ruled.
