The state Superior Court has ruled that an insurer has the duty to cover part of an insured’s payment to settle a federal civil RICO cause of action, even as it explicitly excluded coverage for a breach of contract lawsuit.
In so holding, the appeals court reversed a Philadelphia judge’s ruling that the insurer — which was the carrier for a business professional liability policy — had no duty to provide coverage for the civil RICO settlement.
