Effective July 1, insurers must begin reporting to the government settlements, judgments, awards and other payments made to Medicare beneficiaries.

The Medicare Secondary Payer (MSP) statute, 42 U.S.C. Section 1395y(b), provides that when Medicare makes a payment that a "primary plan" was obligated to make, the payment is only conditional and Medicare is entitled to reimbursement. The MSP’s provisions are already very important when attempting to resolve workers’ compensation, automobile accident, medical benefit and other claims. The MSP statute’s importance will only grow with the onset of the mandatory reporting requirements.
