On June 29, the U.S. Supreme Court granted certiorari in American Needle Inc. v. National Football League , an antitrust case from the 7th U.S. Circuit Court of Appeals. Both plaintiff and defendant had sought certiorari. This case proves to be especially interesting as it marks the 11th time in the last decade that the Supreme Court will hear an antitrust case and will be among one of the first decisions that Sonia Sotomayor makes on the high court, if she is confirmed by the Senate.

Also significantly, the outcome of the decision, which will focus upon the “single entity” defense created by the Supreme Court in Copperweld , will have broad impact well outside of the sports world, including for joint ventures and plaintiffs looking to file suit for antitrust violations and other conspiracy type claims.
