The 3rd U.S. Circuit Court of Appeals has ruled in a case of first impression that the protection of Section 1981 of the Civil Rights Act extends beyond employees to independent contractors.

The three-judge panel voted 3-0 in the result, with Judge Kent A. Jordan concurring, that an independent contractor can bring a discrimination action under Section 1981.
