In a case that demonstrated the tightrope walk between what is and what is not covered by property insurance, a Philadelphia trial judge has ordered an insurer to provide coverage for damages to a Fort Washington, Pa., commercial building caused by a dislodged pipe.
After a two-day bench trial, Philadelphia Common Pleas Judge Howland W. Abramson rejected four different policy exclusions raised by defendant Erie Insurance Exchange, laying out his reasoning why each one was inapplicable, and said the insurer must cover the damages to the building owned by plaintiff Green Street Associates.
