A federal judge presiding over the criminal case against former Orange County, Calif., Sheriff Mike Carona should have allowed the jury to consider evidence of prosecutorial misconduct, Carona’s attorneys argue in a brief appealing his conviction.
Carona, once christened “America’s Sheriff” by Larry King, is appealing his conviction on one count of witness tampering. In January, Carona was found guilty of influencing the grand jury testimony of a local businessman, Dan Haidl, who served as assistant sheriff under Carona. Prosecutors introduced evidence of recorded audiotapes of a meeting between Carona and Haidl in August 2007.
