The Commonwealth Court has affirmed the denial of workers’ compensation benefits for an off-duty Philadelphia Housing Authority police officer who claimed he was taking official police action when he was injured in a bar fight.

The three-judge panel voted 2-1 to affirm a workers’ compensation appeal judge’s denial of plaintiff Lionell Graves’ claim, saying the judge had every right to reject Graves’ testimony and accept opposing testimony from Philadelphia Housing Authority Assistant Police Chief John Haggerty.
