The Commonwealth Court threw out a preliminary injunction stopping the directors of a nonprofit alumni board from recognizing the votes of three chapter members and three emeritus directors in officer elections.

In so ruling, the court said the preliminary injunction was granted without an evidentiary hearing on the board’s decision to refuse recognition of the elected chapter representatives to the board. As a result, no clear right to relief was established, justifying the petitioners’ request for the injunction.
