A Superior Court panel has affirmed the dismissal of a sex abuse lawsuit against the Archdiocese of Philadelphia and St. Thomas Aquinas Catholic Church but refused to open a default judgment of $450,000 entered against the accused priest.

The Rev. Michael D’Onofrio argued on appeal that the rules of serving a civil complaint weren’t followed when the documents were delivered via FedEx to a Peruvian address that the archdiocese provided.
