It is too soon to address the concerns of Pennsylvania school districts over Act 72, which enacts sweeping changes to their funding and taxing authorities, Commonwealth Court President Judge James Gardner Colins wrote, but the case reveals the substance of future challenges to the law, the centerpiece of Gov. Edward G. Rendell’s property tax reform package.

While the Commonwealth Court panel declined to address any of the specific complaints lodged by the Pennsylvania School Boards Association over how the proceeds of the state’s expected gambling revenues might be distributed, they did not dismiss the action. Instead, the three-judge panel decided to publish an opinion.
