The Pennsylvania Medical Professional Liability Catastrophe Loss Fund – now known as the MCARE Fund – is not responsible for “drop-down” coverage when the primary insurer becomes insolvent, a unanimous Commonwealth Court panel has ruled.
The court, led by President Judge James Gardner Colins, also found that the Pennsylvania Property and Casualty Insurance Guaranty Association does not have to pay up to the limits of the insolvent insurer.
