A former firefighter’s disability retirement pension plan is a marital asset under state law and thus subject to equitable distribution in his divorce, an Adams County judge ruled.
Because the disability payments are not for a veteran-related disability, they qualify as marital property under the Divorce Code if the right to receive them accrued during the marriage, Common Pleas Judge Robert G. Bigham determined.
