The state auditor general does not have any inherent power to audit the General Assembly, according to a six-judge panel of the Commonwealth Court, dismissing the petition of political activist Gene Stilp.

Stilp filed the petition in the court’s original jurisdiction alleging that Auditor General Jack Wagner did not perform his “mandated duty” of auditing the Legislature under Article VIII, Section 10 of the Pennsylvania Constitution, according to the opinion in Stilp v.
