In cases of elderly theft by deception, the state sentencing statute’s “mandatory minimum” is not the default sentencing option, the Superior Court has ruled in an issue of first impression.
The ambiguity of the statute caused the dissenting judge to urge the Pennsylvania General Assembly to clarify the sentencing statute with respect to theft by deception.
