Because the state’s MCARE Act does not feature significant statutory changes when compared to its predecessor, the state Supreme Court has ruled that the Commonwealth Court retains original jurisdiction over coverage issues relating to the MCARE Fund.

The decision, reached unanimously by the justices, again eliminates a medical malpractice plaintiff’s requirement to seek relief from the Insurance Department when embroiled in an insurance coverage dispute.
