The state Supreme Court has ruled that the city of Pittsburgh exceeded its authority as a home rule municipality when it passed an ordinance requiring new contractors to offer jobs to employees of the previous contractor for a 180-day transition period.
The court voted 6-1 — with Justice Thomas G. Saylor concurring in the result and Justice Debra Todd dissenting — to affirm the Commonwealth Court’s ruling that Pittsburgh’s Protection of Displaced Contract Workers Ordinance violated the Home Rule Charter and Section 2962(f) of the Optional Plans Law.
