Ruling that minors can collect medical expenses incurred during their minority, the state Supreme Court has cleared the way for the Department of Public Welfare to be reimbursed for Medicaid disbursements it has made on behalf of a minor.

The decision, which was reached by a 5-2 majority, potentially increases the amount of Medicaid funds that can be recovered in “hundreds of pending lawsuits” in which a minor’s parents failed to file a third-party claim before their statute of limitations expired.
