In a child custody proceeding without a clear beginning, middle or end, an order awarding attorney fees doesn’t have to come within 30 days of the disposition, a Superior Court panel has ruled.
The panel affirmed a ruling by a Bedford County Court of Common Pleas judge awarding $5,000 in attorney fees to a father who was falsely accused of molesting his daughter by the girl’s mother in Holler v. Smith, PICS Case No. 07-1030 (Pa. Super. July 2, 2007) Stevens, J. (6 pages).
