A township board’s decision rejecting a home builder’s sewage management plan isn’t a final adjudication and isn’t subject to review, an Adams County Court of Common Pleas judge has ruled.

Addressing an issue of first impression, Judge Michael A. George ruled in Empire Homes v. Highland Township, PICS Case 07-1222 (C.P. Adams Aug. 3, 2007) George, J. (10 pages) that Empire Homes is not entitled to a review of the township board of supervisors’ decision declining to adopt the home builder’s “sewage facilities planning module.”
