An injured worker who received treatments from a massage therapist cannot be seek reimbursement from his employer under the Workers’ Compensation Act, a divided Commonwealth Court panel ruled.

In Boleratz v. Workers’ Compensation Appeal Board, PICS Case No 07-1269 (Pa. Commw. Aug. 24, 2007) Leavitt, J.; Smith-Ribner, J. dissenting (16 pages) the majority rejected Blaine Boleratz’s claim that the Workers’ Compensation Appeal Board erred when it determined that his bills for massage therapy were not payable. Boleratz argued the bills were payable because he received the massage treatments under a referral from his physician.
