Retroactively applying an Allegheny County amendment that shortened the statute of limitations to challenge government takings did not impair the due process rights of two landowners whose property was used for a redevelopment project, the Commonwealth Court has ruled.
In an opinion by Judge Rochelle S. Friedman, the Commonwealth Court affirmed Allegheny County Common Pleas Judge Michael A. Della Vecchia’s ruling that an amendment to Allegheny County’s Urban Redevelopment Law (URL) passed after the taking of Kathleen McDonald and Edward William Kleeman’s property can bar the former landowners from filing a petition for appointment of viewers, without compromising their constitutional rights.
