The state Superior Court has reversed a common pleas judge’s suppression order in a case where a state trooper made a drug arrest after doing a safety check of a legally parked vehicle.

In reversing the order, the Superior Court ruled the trooper’s interaction with the vehicle’s occupant was a mere encounter and not an investigative detention. The court remanded the case for further proceedings.
