In a departure from its recent rulings on gaming issues, the state Supreme Court has put the brakes on casino efforts to accelerate the process and ruled against Foxwoods Casino’s push to start the building process of its waterfront casino, kicking the case down to the lower courts.

Foxwoods asked the court, in Philadelphia Entertainment and Development Partners v. City of Philadelphia, PICS Case No. 07-1878 (Pa. Nov. 20, 2007) Cappy, C.J.; Castille, J. concurring (19 pages) to review the constitutionality of an ordinance passed by Philadelphia City Council that changed the zoning designation of property owned by Foxwoods’ parent company, Philadelphia Entertainment and Development Partners. It also asked the court for a writ of mandamus to compel the city to issue certain permits.
