The certificate of merit rule gives a medical malpractice defendant who has been dismissed a window to file a post-judgment motion for sanctions against the plaintiff’s attorney beyond the customary 30-day period, Allegheny County Common Pleas Judge R. Stanton Wettick has ruled.
In fact, it would be impossible for the defendant to file such a motion within 30 days because the plaintiff has that period after the defendant is dismissed to produce a statement from a medical professional supporting the certificate of merit.
