The shorter, state timeline for appealing an arbitration award applies when an action brought under the Federal Arbitration Act is filed in state court, the Pennsylvania Supreme Court ruled.

The court granted allocatur in Moscatiello v. Hilliard, PICS Case No. 07-2147 (Pa. Dec. 2007) Eakin, J. (10 pages) to determine whether the FAA’s procedural provision that provides for a 90-day timeframe to appeal an arbitration award pre-empts the 30-day time limit found in both Pennsylvania statutory and common law.
