Q: A lawyer filed a personal injury suit stemming from a motor vehicle accident on behalf of both the driver and passenger. The driver was subsequently joined as an additional defendant. I have now taken over the representation of the passenger. Can the lawyer who represented both of them continue in the case?
A: Obviously, the lawyer who brought the suit originally made a wise decision to withdraw from representing the passenger once the driver was joined as an additional defendant. To have remained would have created a real potential for conflict and could have delayed the litigation.
