Because a school district’s collective bargaining agreement with its teachers’ union does not address docking pay in instances when the district fails to meet the state’s requirement of 180 school days, it must pay the teachers their full salaries, a Commonwealth Court panel has ruled.

The decision, reached by a 2-1 majority, affirmed an arbitrator’s award of back pay for members of the Marion Center Area Education Association and rejected the school district’s argument that such an award violated public policy.
