For the second time, a Pennsylvania Court of Common Pleas has dismissed a complaint by the National Rifle Association challenging a city ordinance requiring gun owners to report lost or stolen firearms and providing for a fine or jail time for failure to comply.

In his opinion in National Rifle Association v. City of Pittsburgh, PICS Case No. 09-1214 (C.P. Allegheny July 21, 2009) Wettick, J. (7 pages), Judge R. Stanton Wettick Jr. sustained the city’s preliminary objections, which claimed the plaintiffs lacked standing. Wettick concurred that “persons cannot ask courts to consider the legality of laws promulgated by elected bodies simply because they disagree with these laws.”
