In a case with a fact pattern out of a “Law & Order” episode, the Commonwealth Court has denied two state police employees reimbursement of attorney fees and costs related to a civil suit filed against them and the state over their investigation of a murder 40 years ago.

In a 4-1 decision in Balshy v. Pennsylvania State Police, the court found the state’s Office of General Counsel was within its discretion when it determined substantial evidence showed former PSP Cpl. John C. Balshy and former PSP chemist Janice Roadcap acted maliciously, in bad faith and outside the scope of their employment.
