The court of its own accord examined venue and issued an order directing plaintiff to make an election to transfer the case.
The matter arose out of a construction accident, and defendants filed preliminary objections. They did not raise venue, which the court acknowledged was to be considered waived if not raised in preliminary objections. However, of its own volition, the court noted that the accident occurred in another county, and all the parties were residents elsewhere. There simply was no connection to Beaver County. It stated, “This Court refuses to give deference to the Plaintiff’s choice of forum in a case in which venue is initially improper in Beaver County.”
