An en banc panel of the Superior Court, ruling a trial judge’s decision lacked any foundation in science or evidence, reversed his ruling that asbestos plaintiffs could not extrapolate that asbestos-related diseases were the result of exposures from work in the automotive repair industry.
In Betz v. Pneumo Abex Corp., the Allegheny County trial judge dismissed an argument by a plaintiff expert extrapolating that if large doses of asbestos exposure cause mesothelioma, so too do smaller doses. Judge Robert J. Colville granted a global Frye motion on behalf of several friction product defendants and subsequently granted summary judgment in their favor.
