On April 6, the U.S. D.C. Cicuit Court of Appeals dealt a striking blow to supporters of net neutrality.
In Comcast v. FCC, the court overturned, by unanimous decision, a 2008 enforcement action by the Federal Communications Commission against Pennsylvania-based Comcast Corp., enjoining Comcast from using its broadband management practices to discriminate against certain Internet applications. The resounding significance of the Comcast decision is that the FCC does not have authority to regulate broadband Internet and, consequently, likely does not have authority to implement the net neutrality policies promulgated earlier this year.
