A deeply divided state Supreme Court last week dismissed a class action claiming gross negligence by the city of Philadelphia in allegedly mismanaging a deferred compensation plan for its employees, because the majority said class plaintiffs incorrectly pleaded a tort theory, not a contract theory.
The decision came on a 4-3 vote.
