In a ruling that may prove to be the last gasp of litigation over the controversial 2005 pay raise for Pennsylvania judges and lawmakers, a federal appeals court has upheld the dismissal of a civil rights suit brought by theLeague of Women Voters against the late Pennsylvania Chief Justice Ralph Cappy.
In the suit, the League of Women Voters claimed that Cappy had cut a backroom deal to secure the pay raise legislation by promising to rule against the League of Women Voters and its co-plaintiffs in a then-pending state court challenge to Pennsylvania’s gaming statute.
