The 1st U.S. Circuit Court of Appeals has vacated a jury verdict against insurer Unum Group and remanded the False Claims Act case about Unum customers’ Social Security claims because the district court excluded evidence.

On July 29, a unanimous panel ruling in U.S. ex. rel. Loughren v. Unum Group found that the district court “abused its discretion in excluding certain evidence that is highly relevant to one of the elements necessary to prove Unum’s liability.”
