The state Supreme Court has granted a new sentencing hearing to a murder convict on death row in Lebanon County, Pa.

The justices ruled 6-1 in the result but only Justice Debra Todd fully joined Justice Max Baer’s majority opinion affirming a Post Conviction Relief Act court’s decision that called for a new sentencing hearing on the grounds that defendant Bradley Martin’s attorney was ineffective for not investigating and presenting mitigating evidence at trial.
