A Philadelphia Orphans’ Court judge has ruled that a coal-mining company must vacate coal mines owned by the estate of Stephen Girard, which has been bequeathed to the city of Philadelphia, because the company has not had a written agreement with the estate since 2002.

In a decree issued by Orphans’ Court Administrative Judge Joseph O’Keefe earlier this year, the judge said that PAC 23 Mining Company, which has occupied the Schuylkill County coal mines owned by the estate since 1989, had to vacate the coal mines. O’Keefe also ruled that PAC 23 owes the estate for mining royalties earned in 2009 and 2010.
