The state Supreme Court has granted allocatur to determine whether a ski resort’s exculpatory agreement should release it and its employee from liability for reckless or intentional conduct.
The court said in a per curiam order that it will examine whether allowing such a release is against public policy and, if it is not, how specific the language in the agreement must be to successfully release a party from recklessness.
