Seasonal civil service commission employees may not graduate from their probationary status by simply remaining on the job for a set number of years, the Commonwealth Court has ruled.

The unanimous three-judge panel’s decision in Norvell v. State Civil Service Commission , which impacts who bears the burden to prove — or disprove — whether a civil service employee was fired for just cause, held that evaluation reports and years of service could not alone trigger a change in employment status.
